US Judge Mandates Freedom of Abrego Garcia from Immigration Custody

A court has ruled the prompt discharge of Kilmar Abrego Garcia from detention by ICE, concluding his ongoing detainment is without lawful basis.

"Since his release after erroneous imprisonment in El Salvador, he has been re-detained, again without legal justification," Judge Paula Xinis wrote in her ruling.

The case stems from a mistaken removal to El Salvador earlier this year, which the government later acknowledged was an error. Following his repatriation to the United States to face human smuggling allegations, he was detained in federal custody.

In her decision, the court noted that the government lacks a valid deportation order, which effectively blocks them from deporting Mr. Abrego Garcia "at this juncture."

Context of the Case

The legal proceedings center on conflicting claims. While the former administration contends that Abrego Garcia is a affiliate of the MS-13 criminal organization, he vehemently denies this allegation.

He has also pleaded not guilty to the conspiracy counts, which are part of a separate criminal case in the state of Tennessee.

The judge, who was hearing his petition to removal in a Maryland district court, determined that he must now comply with the terms of his release from jail in Tennessee. This order shifts his supervision to the Tennessee court.
